Notification of the arrival of a foreigner in Kazakhstan

The Migration Service of the Ministry of Internal Affairs on its website published a reminder that receiving persons from the Kazakh side are obliged to notify about the arrival of a foreigner.

According to paragraph 9 of the “Rules of Entry and Stay of immigrants in the Republic of Kazakhstan”, approved by the Decree of the Government of the Republic of Kazakhstan No. 148 dated January 21, 2012, individuals and legal entities that accept foreign citizens are required to notify the internal affairs bodies of immigrants staying at home.

This notification must be submitted within three working days from the date of arrival of a foreign citizen.

Acting Chairman of the Migration Service Committee of the Ministry of Internal Affairs of the Republic of Kazakhstan Aslan Atalykov noted:

“In case of missing the specified period and not notifying the internal affairs bodies of the immigrant’s stay, the natural and legal person receiving in Kazakhstan will be held liable under Article 518 of the Code of Administrative Offences of the Republic of Kazakhstan.

For legal entities, a fine of 10 to 25 monthly calculation indices is provided, and in case of repeated violation – up to 100 monthly calculation indices, which is equivalent to 306 thousand tenge.
Punishment in the form of a warning is provided for individuals, and for repeated violation – a fine in the amount of 30 monthly calculation indices or 91,890 tenge.”
It is known that the receiving party can file a notification of the arrival of a foreigner in three ways:

1. Individuals and legal entities may inform about the arrival of an immigrant directly through the electronic visa and migration portal at vmp.gov.kz or through egov.kz . To do this, it is enough for the Kazakh side to have an electronic digital signature and passport data of an immigrant.

2. Individuals and legal entities receiving from the Kazakh side may submit notifications of the arrival of a foreigner directly to the departments and offices of the migration service of the internal affairs bodies in their area.

3. Through the E-Qonaq application, which can be downloaded from the App Store or Play Market to a mobile device. And the notification is served literally in two steps. It is even possible to download a foreigner’s passport data by scanning his passport through a smartphone camera. Authorization and filling out notifications are intuitive. Take a minute of time.

It should also be noted that the address specified in the Notification must match the residential address specified in the Rental Agreement.

If the address of residence has changed after notification, it is necessary to notify the migration authority again with an indication of the address that matches the address in the Lease Agreement.
