New criteria for public procurement from March 22
The rules of public procurement have been amended. This was reported in the Ministry of Finance of the Republic of Kazakhstan.
“In order to fulfill the instructions of the Head of State, state bodies are working to take measures to demonopolize the construction market and its competitive development. The Ministry of Finance is carrying out relevant work within its competence,” the press service of the ministry notes.
According to the Ministry of Finance, on March 1 of this year, Order 225 (registered with the Ministry of Justice on March 2, 2023, 31994) amended the Rules for Public Procurement (approved by Order of the Minister of Finance of the Republic of Kazakhstan on December 11, 2015, 648).
“Now, when calculating conditional discounts, additional criteria affecting the competitive price offer in the form of a territorial attribute and negative values will be taken into account. So, suppliers registered in the area of work will be assigned a conditional discount of 1%,” says Murat Adilkhanov, Director of the Department of Legislation of Public Procurement and Procurement of the quasi-public Sector of the Ministry of Finance.
According to him, the territorial feature will be applied to public procurement of up to 400 thousand MCI for construction and installation works and works not related to construction, except for works on complex non-departmental expertise and development of feasibility studies, PSD.
“This criterion contributes to the development and support of small and medium-sized businesses, as well as an increase in tax revenues in the relevant region. At the same time, 0.1% of the total conditional discount for each contract will be taken away from a potential supplier who has a public procurement contract concluded in the current financial year,” Murat Adilkhanov added.
It is noted that negative values will be applied to construction and installation works, works on complex non-departmental expertise, development of feasibility studies, PSD and engineering services.
“This will make it possible to evenly and fairly distribute the volume of public procurement, eliminate the current monopoly position of individual large companies that participate in all public procurement, preventing small and medium-sized businesses from developing. In general, these novels will allow to demonopolize the construction market and develop competition. The new criteria will be applied to public procurement published after the entry into force of the Order, that is, from March 22 of this year,” Murat Adilkhanov said.
