Citizens of EAEU countries can work remotely in enterprises in Kazakhstan

Integration processes within the framework of the Eurasian Economic Union have contributed to the amendment of the Labour Code. 

For example, the changes enable citizens of EAEU member States to work remotely in enterprises located in Kazakhstan.

Also, amendments were made to the Labor Code of the Republic of Kazakhstan to simplify the procedure for transferring workers from normal work to remote work during an emergency, emergency and other restrictive measures. In addition, the possibilities of using a mixed mode of operation have been improved, in which remote and regular work alternates, taking into account the specifics of the activity. Along with this, the rights and obligations of the employer and employee in the framework of mixed and remote modes of work and a number of other changes are spelled out.

At the same time, the Treaty on the Eurasian Economic Union does not contain norms governing which country’s legislation should be applied by an employer who accepts a citizen of an EAEU member state for remote work.

In this regard, currently, as part of the implementation of the Strategic Directions for the Development of Eurasian Economic Integration until 2025, proposals are being developed on the need to regulate the legal status of workers performing work in a Member State if the employer is registered in the territory of another EAEU Member State.
