Minister of Labor about the development of the Social Code of Kazakhstan
In 2020, the Head of State Kassym-Jomart Tokayev, in his Address, instructed to develop a Social Code.
As a result of the analytical work on the development, it was proposed to form a Code of two parts – general and special. The general part establishes the foundations for the legal regulation of social relations arising between the state and the citizen with a clear delineation of their mutual rights and obligations. A special part is devoted to certain types of social risks, where measures to respond to them, categories of social assistance recipients, amounts of social payments, conditions and terms for their assignment will be determined.
“Currently, employees of our ministry are working on a new, very important law – the draft Social Code of the Republic of Kazakhstan. It will combine all the current legislative acts in the field of social protection of the population, providing support for citizens and the provision of state guarantees from the moment of birth until they enter a well-deserved rest,” the Minister of Labor and Social Protection of the Population of the Republic of Kazakhstan Tamara Duysenova says in her message.
Earlier in October last year, when announcing the development of the Social Code, Anzhelika Parsegova, Director of the Department of Legal Services of the Ministry of Labor and Social Protection of the Population, in an interview with MIA Kazinform, explained the tasks that will be solved with the adoption of the Social Code:
“During the development of the Code, a number of basic approaches have been formed.
Firstly, it is the strengthening of measures to ensure social rights and guarantees, within the framework of which it is planned to create uniform parameters for ensuring social rights and improve the legal literacy of the population, including through the introduction of a “social calculator”.
Secondly, the modernization of social support for citizens, which provides for the provision of social payments at a level not less than the international minimum standards of social security, as well as the introduction of per capita normative financing of social services.
The next is an integrated model for providing social standards. As part of this measure, it is planned to introduce a Digital Social Card to assess the level of well-being of citizens and to introduce preventive measures to provide social support.
Also, the next approach is to transform and reengineer public services, which is a transition from declarative to proactive provision of public services, as well as the development of mobile and electronic services. At the same time, the approach to reforming social institutions can be noted.
In the future, the adoption and implementation of the Social Code will make it possible to: create a single source of citizens’ knowledge about their social rights and obligations, eliminate duplication and fragmentation of norms; conduct automated monitoring of the social welfare of the population; take preventive measures to ensure social rights, including the provision of public services in a proactive format.”
According to the Minister of Labor of the Republic of Kazakhstan, the document also contains innovations that provide for improving the pension provision of Kazakhstanis, strengthening measures of social support for families with children, improving the procedure for determining disability, and more.
