Kazakhstan intends to abolish the use of the death penalty. The Constitutional Council of the Republic of Kazakhstan gave an official interpretation to the provisions of the Constitution regulating the use of the death penalty
The head of state appealed to the Constitutional Council in view of the upcoming ratification by Kazakhstan of the Second Optional Protocol to the International Covenant on Civil and Political Rights, aimed at abolishing the death penalty.
The Constitutional Council decided that there was no need to amend the Constitution for the ratification of the Optional Protocol. At the same time, the Council noted that after the ratification of the Optional Protocol, the Criminal Code of the Republic of Kazakhstan must be brought in line with its requirements.
